A federal judge has ruled the prompt discharge of Kilmar Abrego Garcia from detention by ICE, concluding his continued detainment lacks legal authority.

"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without lawful authority," Judge Paula Xinis wrote in her order.

The situation originates in a mistaken removal to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to face alien smuggling charges, he was held in immigration custody.

In her order, the judge noted that the government does not have a current removal order, which effectively blocks them from deporting Mr. Abrego Garcia "at this time."
